  • Staff Recommendation:

    THAT Council Adopt the Agenda for the Regular Council Meeting held on November 5, 2024 as presented.

  • Staff Recommendation:

    THAT Council adopt the Regular Council Meeting minutes of October 15, 2024 as presented.

  • Staff Recommendation:

    THAT Council approve the Consent Agenda:

    1. October 9, 2024 Accessibility Committee Meeting Minutes;
    2. October 15, 2024 Committee of the Whole Meeting Minutes; and 
    3. October 23, 2024 Parks and Recreation Advisory Committee Meeting Minutes.
  • Staff Recommendation:

    THAT Council receive into the record the report dated November 5, 2024, titled “Q3 2024 - Public Safety and Partnerships Division Updates”, representing work completed between July 1, 2024 – September 30, 2024.

  • Staff Recommendation:

    THAT Council receive into the record the report dated November 5, 2024, titled “Q3 2024 – RCMP Update” from the Officer in Charge, Penticton RCMP Detachment.

  • Staff Recommendation:

    THAT Council receive into the record the report dated November 5, 2024, titled “Q3 2024 – Capital Project Update”.

  • Staff Recommendation:

    THAT Council receive into the record the report dated November 5, 2024, titled “Q3 2024 - Economic Development Update”.

  • Staff Recommendation:

    THAT Council rescind “Snow and Ice Control Policy CP#2023-09”;

    AND THAT Council approve “Snow and Ice Control Policy CP#2024-02”, a policy that provides a balance between public safety, the City’s snow and ice removal resources, and the annual available budget.

  • Staff Recommendation:

    THAT Council receive for information the feedback and recommendation from the Parks and Recreation Advisory Committee (PRAC) relating to the Kiwanis Pier Project and optional scope reduction;

    AND THAT Council consider the recommendation and the overall scope and budget for the project through the upcoming budget deliberations.

  • Staff Recommendation:

    THAT Council revise the 2024 Council meeting schedule and cancel the Special Council meeting of November 21, 2024;

    AND THAT Council select the following dates for the 2025 Regular Meetings of Council: January 14, 28; February 11, March 4, 18; April 1, 22; May 13, 27; June 10, 24; July 15, August 19; September 16; October 7, 21; November 4, December 2, 16;

    AND THAT Special Council meetings be held on November 18 and 19, 2025 for budget deliberations.

  • Staff Recommendation:

    THAT Council approve free on-street parking in the downtown area for Fridays and Saturdays for the five weekends beginning November 29, 30, December 6, 7, 13, 14, 20, 21, 27 and 28.

Re:  689 Winnipeg Street

  • Staff Recommendation:

    THAT Council give first reading to “Zoning Amendment Bylaw No. 2024-38”, for Lot A District Lots 4 and 202 Group 7 Similkameen Division Yale District (Formerly Yale-Lytton) Plan EPP138406, located at 689 Winnipeg Street, a bylaw to add the following site specific provisions to the C1-Commercial Transition Zone

    Site Specific Provisions for 689 Winnipeg Street:

    • Allow bakery as a permitted use
    • Restaurant shall not exceed a maximum gross floor area of 650m2
    • Minimum 4 vehicle parking stalls to be provided
    • The rear yard setback for an accessory structure shall be 0.0m

    AND THAT Council forward “Zoning Amendment Bylaw No. 2024-38” to the December 3, 2024 Public Hearing.

    AND THAT Council, subject to adoption of “Zoning Amendment Bylaw No. 2024-38”, approve “Development Permit PL2024-9878”, a permit to approve the form and character of the proposed conversion of the existing buildings to a restaurant and bakery.

Re:  939 Dynes Avenue

  • Staff Recommendation:

    THAT Council approve “Development Variance Permit PL2024-9799” for Lot 26 District Lot 3 Group 7 Similkameen Division Yale (Formerly Yale Lytton) District Plan 929, located at 939 Dynes Avenue, a permit to vary section 10.2.2.7 of the Zoning Bylaw to reduce the interior side yard setback from 1.5m to 0.6m on the east side and 1.1m on the west side, in order to facilitate the construction of an addition to the existing single-family dwelling;

    AND THAT Council direct staff to issue “Development Variance Permit PL2024-9799”.

Re:  1340 Carmi Avenue

  • Staff Recommendation:

    THAT Council approve “Temporary Use Permit Renewal PL2024-9895”, a permit to extend the Temporary Use Permit for three years until July 20, 2027 to allow the use of ‘indoor amusement, entertainment, and recreation’ for an indoor off-ice hockey training facility on Lot 1 District Lots 2710 and 3821S Similkameen Division Yale District Plan 197767, located at 1340 Carmi Avenue;

    AND THAT Council direct staff to issue the permit for another three years.

Re:  480 Vancouver Avenue

  • Staff Recommendation:

    THAT Council approve the five (5) year License to Use Agreement, with the Penticton Community Gardens Society, for the use of a portion of 480 Vancouver Avenue for the purpose of operating a community garden;

    AND THAT Council authorize the Director of Finance and Administration and Corporate Officer to execute the License to Use agreement.

Re:  2460 Baskin Street (Parkland Community Garden)

  • Staff Recommendation:

    THAT Council approve the five (5) year License to Use Agreement, renewal with Food Foresters Society of Canada for the purpose of operating a community garden (known as Parkland Community Garden) located at 2460 Baskin Street;

    AND THAT Council authorize the Director of Finance and Administration and Corporate Officer to execute the License to Use agreement.

  • Staff Recommendation:

    THAT Council recess to a closed meeting of Council pursuant to the provisions of the Community Charter as follows:  Section 90 (1)

    (a)  personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

    (e)  the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality; and Section 90 (2)

    (b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

Re:  955 Timmins Street

  • Staff Recommendation:

    THAT Council give second and third reading "Official Community Plan Amendment Bylaw No. 2024-36";

    AND THAT Council give second and third reading to "Zoning Amendment Bylaw No. 2024-37".
